1. Agreement to Terms
These Terms of Service (“Terms”) govern your access to and use of ElionNexus, including our website, portals, pricing data, and related services (collectively, the “Platform”).
By registering for an account or using the Platform, you agree to be bound by these Terms. If you are using the Platform on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Accounts and Registration
To access certain features, you must create an organization account and provide accurate, complete registration information. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
You must promptly notify us of any unauthorized access or security breach. We reserve the right to suspend or refuse registration where information is incomplete, inaccurate, or does not meet our eligibility requirements.
3. Use of the Platform
3.1. Permitted Use
You may use the Platform to:
- Access fuel pricing data within your membership tier
- Monitor price changes, trends, and alerts for your market
- Publish pricing data if you are an authorized oil company user
- Manage your organization profile, users, and subscription
3.2. Prohibited Use
You agree not to:
- Scrape, copy, or redistribute Platform data outside permitted exports
- Share account access with unauthorized third parties
- Submit false, misleading, or manipulated pricing information
- Attempt to bypass tier restrictions or security controls
- Use the Platform for unlawful purposes or to harm other users
- Reverse engineer or interfere with Platform infrastructure
4. Membership and Billing
Access to pricing data and features depends on your selected membership tier and billing cycle. Fees, renewal terms, and tier entitlements are described on our pricing page and in your account dashboard.
Subscriptions renew automatically unless cancelled before the renewal date. Refunds are handled according to the billing policy stated at the time of purchase. We may change pricing or tier features with reasonable notice to active subscribers.
5. Intellectual Property
The Platform, including its software, design, branding, and compiled datasets, is owned by ElionNexus or its licensors and is protected by applicable intellectual property laws.
Pricing data submitted by oil companies remains subject to their rights, but you grant us a license to host, display, and distribute that data through the Platform as needed to provide our services. No rights are granted except as expressly stated in these Terms.
6. Limitation of Liability
The Platform provides pricing intelligence for informational purposes. We do not guarantee the accuracy, completeness, or timeliness of market data, and you are responsible for verifying information before making commercial decisions.
To the fullest extent permitted by law, ElionNexus shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data arising from your use of the Platform.
7. Termination
You may close your account at any time through your account settings or by contacting support. We may suspend or terminate access if you breach these Terms, fail to pay applicable fees, or if continued access poses a security or legal risk.
Upon termination, your right to use the Platform ends immediately. Provisions that by their nature should survive termination will remain in effect.
8. Changes to These Terms
We may update these Terms to reflect changes to the Platform, our business, or legal requirements. Material changes will be communicated through the Platform or by email, and the “Latest update” date will be revised accordingly.
Continued use of the Platform after updated Terms take effect constitutes acceptance of the changes.
